Terms of Service
Please read these terms carefully before using FormNode. By accessing or using the service, you agree to be bound by these terms.

1. Introduction
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Symao Systems LLC, an Indiana limited liability company that operates FormNode ("FormNode," "we," "us," or "our"), governing your access to and use of the FormNode platform available at formnode.io and app.formnode.io, including all related services, features, content, and applications (collectively, the "Service").
By creating an account, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
FormNode is a cloud-based software-as-a-service (SaaS) platform that provides:
- A form builder with webhook automation for connecting forms to external workflows and services
- Dynamic cascading fields that pull live data from external APIs to populate form options in real time
- Approval workflows with human-in-the-loop decision points for routing submissions through review and authorization processes
- A customer portal enabling end users to access, submit, and track forms assigned to their organization
- A REST API and MCP (Model Context Protocol) server for programmatic access and AI agent integration
- Multi-tenant workspaces with organization management, role-based access control, and team collaboration features
- An embeddable form SDK supporting inline, popup, and slide-in display modes
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. Account Registration and Security
To use the Service, you must create an account. By registering, you agree to the following:
- Age requirement. You must be at least 18 years of age to create an account and use the Service.
- One account per person. Each individual may maintain only one account. Creating multiple accounts to circumvent plan limits or for any other purpose is prohibited.
- Account security. You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately at support@formnode.io if you become aware of any unauthorized access to or use of your account.
- Authentication. The Service provides authentication via magic link (email-based passwordless login) and Microsoft SSO. You are responsible for securing access to the email account or Microsoft identity associated with your FormNode account.
- Workspace responsibility. Workspace owners are responsible for the actions of all team members within their workspace. This includes ensuring that invited members comply with these Terms.
- Accurate information. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.
4. Billing, Subscriptions, and Payments
FormNode offers both free and paid subscription plans:
- Free tier. The Starter plan is available at no cost and provides access to core features with certain limitations as described on our pricing page.
- Paid plans. The Pro plan is available at $49 per month and the Business plan at $129 per month. Paid plan access begins when checkout is completed.
- Merchant of record.All payments are processed by Creem.io, which acts as our merchant of record. By subscribing to a paid plan, you also agree to Creem.io's terms of service as they apply to payment processing.
- Billing cycle. Paid subscriptions are billed monthly. Your billing cycle begins on the date you subscribe to a paid plan.
- Cancellation. You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. Your workspace and all associated data will be permanently deleted 24 hours after your billing period ends.
- No refunds. We do not provide refunds for partial months of service. If you cancel mid-cycle, you will continue to have access for the remainder of that billing period, but no pro-rated refund will be issued.
- Price changes.We reserve the right to change our pricing at any time. If we increase prices for your current plan, we will provide at least 30 days' advance notice via email before the new pricing takes effect. Continued use of the Service after the price change constitutes acceptance of the new pricing.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in compliance with these Terms. The following activities are strictly prohibited:
- Illegal content. Using the Service to create, distribute, or collect content that violates any applicable local, state, national, or international law or regulation.
- Spam, phishing, and malicious forms. Creating forms designed to deceive, phish, spam, or otherwise harm recipients or collect information under false pretenses.
- Automated abuse. Using bots, scripts, or automated tools to abuse the platform, generate artificial submissions, or otherwise interfere with the normal operation of the Service.
- Circumventing limits. Attempting to bypass, circumvent, or manipulate rate limits, plan restrictions, usage quotas, or any other technical limitations of the Service.
- Impersonation. Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
- Sensitive data without compliance. Collecting sensitive personal data — including but not limited to Social Security numbers, government identification numbers, financial account numbers, or protected health information — without implementing appropriate legal, technical, and organizational compliance measures (such as HIPAA, PCI-DSS, or equivalent frameworks).
FormNode reserves the right to investigate violations of these Terms and to suspend or terminate accounts that engage in prohibited activities, at our sole discretion and without prior notice.
6. Data Ownership and Intellectual Property
- Your data.You retain full ownership of all data you create, upload, or collect through the Service, including form definitions, submission data, organization data, and any other content you provide ("Customer Data").
- Our platform.FormNode and its licensors retain all rights, title, and interest in and to the Service, including all software, code, design, branding, trademarks, and documentation. Nothing in these Terms grants you any right to use FormNode's trademarks, logos, or branding without our prior written consent.
- License to process. By using the Service, you grant FormNode a limited, non-exclusive, worldwide license to access, process, store, and transmit your Customer Data solely for the purpose of providing, maintaining, and improving the Service.
- Encryption. Submission data is encrypted at rest using AES-256-GCM encryption with per-record salts derived via PBKDF2. While we implement strong security measures, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.
7. API and Integration Terms
Access to FormNode's API and integration features is subject to the following terms:
- Rate limits. API access is subject to rate limits that vary by subscription plan. You agree not to exceed the rate limits applicable to your plan, and you acknowledge that requests exceeding these limits may be throttled or rejected.
- API key security. API keys are confidential credentials. You are solely responsible for securing your API keys and for any activity that occurs using your keys. You must not share API keys publicly or embed them in client-side code.
- MCP server. Access to the FormNode MCP server is governed by the same terms and rate limits that apply to the REST API.
- Webhook delivery. Webhook delivery is provided on a best-effort basis with automatic retry. FormNode does not guarantee delivery of webhooks and is not liable for failures caused by destination server unavailability, network issues, or other factors outside our control.
- Changes to APIs. We may modify, deprecate, or discontinue API endpoints or features at any time. We will make reasonable efforts to communicate material changes in advance, but we do not guarantee backward compatibility.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- As-is basis.THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- No uptime guarantee. While we strive to maintain high availability, we do not guarantee uninterrupted or error-free operation of the Service. We are not liable for any downtime, data loss, or service interruptions.
- Exclusion of damages. IN NO EVENT SHALL FORMNODE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
- Liability cap.FORMNODE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO FORMNODE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
- Customer responsibility. You are solely responsible for the content of your forms, the data you collect through the Service, and your compliance with all applicable laws and regulations governing data collection, privacy, and consumer protection.
9. Termination
- Termination by you. You may terminate your account at any time by canceling your subscription and deleting your account through the Service settings, or by contacting us at support@formnode.io.
- Termination by FormNode. We may suspend or terminate your account immediately, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or otherwise pose a risk to the Service or other users.
- Data export. Upon termination, you will have a 24-hour window to export your data through the Service. We recommend exporting your data before initiating account termination.
- Data deletion. After the 24-hour data export window, all Customer Data associated with your account will be permanently and irreversibly deleted. FormNode is not obligated to retain or provide access to any data after this period.
- Survival. The following sections survive termination: Section 6 (Data Ownership and Intellectual Property), Section 8 (Limitation of Liability), Section 10 (Indemnification), and Section 11 (General Provisions).
10. Indemnification
You agree to indemnify, defend, and hold harmless FormNode and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) the content of your forms or the data you collect; or (e) any third-party claim related to your Customer Data.
11. General Provisions
- Governing law. These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States of America, without regard to conflict-of-law principles. The exclusive venue for any dispute arising under these Terms shall be the state and federal courts located in Porter County, Indiana.
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FormNode with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
- Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
- No waiver. The failure of FormNode to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by FormNode.
- Assignment. You may not assign or transfer these Terms, or any rights or obligations hereunder, without the prior written consent of FormNode. FormNode may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.
- Notices. We may provide notices to you via email to the address associated with your account or through in-app notifications. You are responsible for keeping your contact information current.
- Force majeure. FormNode shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, or third-party service failures.
